Welcome to eventanew ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

  • You must be at least 18 years old to create an event or an account.
  • By creating an account, you represent that all information you provide is accurate and complete.
  • You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

2. Event Creation and Access

  • When you create an event, the Service generates a unique, unlisted URL and corresponding QR code.
  • Events are not indexed or discoverable publicly.
  • Anyone with the event link or QR code can access and upload content to the event page.
  • You understand and agree that sharing the link or QR code with others gives them access to your event content.

3. Event Owner Responsibilities

By creating or managing an event, you agree that you are solely responsible for:

  1. Determining who may access your event and distributing your event link or QR code only to trusted guests.
  2. Obtaining all necessary permissions and consents from individuals depicted in uploaded photos or videos, including parents or guardians for minors.
  3. Ensuring compliance with applicable privacy, publicity, and data protection laws.
  4. Managing and removing any content uploaded to your event.
  5. Using the Service only for lawful purposes.

We provide the platform for you to collect and store event media but do not monitor or control your event’s content or sharing.

4. Guest Uploads and Conduct

Guests invited to an event may upload photos, videos, and other media (“User Content”).

Guests agree not to upload:

  • Any content that violates laws or rights of others, including copyright, privacy, or publicity rights.
  • Explicit, obscene, harassing, defamatory, or illegal material.
  • Media involving minors without appropriate consent.

We reserve the right to remove or disable content or accounts that violate these Terms or applicable law.

5. Ownership and License

  1. You retain ownership of your uploaded media.
  2. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display the content solely to operate the Service.
  3. Event owners may view, download, or share content from their own events; we do not claim ownership over uploaded media.

6. Storage and Integrations

  1. Event media is stored securely in AWS S3 cloud storage.
  2. We maintain appropriate security measures to protect your data as described in our Privacy Policy.
  3. You can download your event gallery at any time.

7. Privacy and Data

Your use of the Service is governed by our Privacy Policy

8. Children’s Privacy and Content Involving Minors

Our Service is not directed to children under 13.
Children under 13 may not create accounts or upload media.
Event owners are responsible for ensuring that any media including minors complies with applicable law and that parental or guardian consent has been obtained as required.
If we are notified that content involving a child under 13 has been uploaded without proper authorization, we will promptly remove it.

9. Takedown and Reporting

If you believe content on our platform violates privacy, publicity, or copyright rights:

  • Include the event link, description of the content, and your request.
    We will review and respond promptly in accordance with applicable law.

10. Security

We implement reasonable safeguards (including encryption and access controls) to protect data. However, no online service is completely secure, and we cannot guarantee absolute security.

11. Termination

We may suspend or terminate accounts or events that violate these Terms, our policies, or applicable law. You may delete your account or events at any time.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any loss, disclosure, or misuse of event links, QR codes, or uploaded content shared by users.
  • We are not responsible for actions of guests, event owners, or third parties.
  • Our total liability for any claim shall not exceed the amount you paid (if any) for the Service in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless eventanew, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service,
  • Your event content, or
  • Violation of these Terms.

14. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the United States, without regard to conflict of law principles.
  • Disputes shall be resolved by arbitration or courts located in the United States, unless prohibited by law.

15. Changes

We may update these Terms periodically. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
